Restructuring Debt Through Chapter 13 Bankruptcy

 

When you file Chapter 13 bankruptcy, we will divide your debt into two kinds:

 

  • Debts that must be repaid in full, such as secured debts and priority tax debts
  • Dischargeable debts such as credit card bills, medical bills and payday loans, for which you have to pay only what you can afford.

Some people may qualify to pay only around $100 per month for three years and discharge up to $360,475 in unsecured debts. (The maximum amount that may be discharged might change over time).

 

Chapter 13 bankruptcy allows you to restructure debts such as tax debt and mortgage arrearages and pay them off over the three- to five-year period. At the same time, it protects your assets from adverse events such as foreclosure, repossession and wage garnishment.
